What Benefit Categories Apply to Your Claim?

California workers’ compensation recognizes two categories of permanent disability. Which one applies to your situation directly determines how much you receive and for how long.

The two types of permanent disability benefits in California are:

Permanent partial disability (PPD): Stems from an injury or illness that causes lasting impairment but only partially limits your ability to perform job functions. PPD is by far the more common classification and covers a wide range of injury severity.
Permanent total disability (PTD): Applies when an injury or illness leaves you completely unable to perform your job or any similar work. PTD requires a medical determination of 100% disability and is awarded far less frequently than PPD.

The category you fall into, combined with your disability rating percentage, determines your weekly benefit payments and total award. Permanent disability payments are calculated as a percentage of pre-injury wages, subject to California’s statutory weekly minimums and maximums. Workers with a rating of 70% or higher may also qualify for a life pension on top of standard permanent disability payments.

Permanent & Stationary Status: What It Means for Your Benefits

Before a permanent disability award can be calculated, your treating physician must declare you “permanent and stationary” (P&S), meaning your condition has stabilized and is unlikely to improve further with additional treatment. Some physicians use the equivalent term “maximum medical improvement” (MMI). The label differs. The legal effect is the same.

The P&S declaration is a turning point in your claim. Once it’s made, temporary disability payments typically stop. Your physician must then send a report to the claims administrator confirming permanent disability status and addressing apportionment, which is the process of allocating what portion of your impairment is attributable to the work injury versus any pre-existing conditions or prior injuries.

If there’s a dispute about whether you’ve actually reached P&S, or if your disability rating is contested, your income can be cut off entirely during that period. Having an attorney at this stage helps ensure the medical report accurately reflects your condition and that your benefits aren’t wrongly terminated while the dispute plays out.

How Your Permanent Disability Rating Is Calculated

Permanent disability in California is expressed as a percentage. That percentage determines the number of weekly payments you receive and the total dollar value of your award. Getting it right matters.

The rating process starts with your physician’s impairment finding, evaluated using the American Medical Association (AMA) Guides to the Evaluation of Permanent Impairment. That base impairment figure is then adjusted using a formula that accounts for your age at the time of injury and your occupation. The occupation adjustment reflects how much the impairment limits your ability to meet the specific physical demands of your work.

Apportionment can significantly reduce the final number. If a pre-existing condition or prior injury contributed to your current impairment, the claims administrator may argue that only a portion of your disability is work-related. Insurers use apportionment aggressively, and an inaccurate finding can cost a worker thousands of dollars in lost benefits. Challenging it is one of the most valuable things an attorney can do in a Sacramento permanent disability case.

Key factors that shape your permanent disability award:

Return-to-Work Supplement Program & the SJDB Voucher

If your permanent disability prevents you from returning to your date-of-injury job, you may be entitled to a supplemental job displacement benefit (SJDB) voucher. The SJDB voucher provides up to $6,000 to cover retraining, education, or skill development costs so you can move into a different occupation. It’s a separate benefit from your permanent disability award, not a substitute for it.

Workers whose injury date is on or after January 1, 2013, and who receive an SJDB voucher, may also be eligible for a one-time $5,000 payment through California’s Return-to-Work Supplement Program (RTWSP). This program is administered by the California Department of Industrial Relations and requires a separate application submitted within one year of the date the SJDB voucher was mailed to you.

The RTWSP deadline is easy to miss, especially when you’re managing medical appointments and claim disputes at the same time. Many workers lose this benefit simply because no one flagged the deadline.
