Help from Our Sacramento Lawyers After a Settlement

Learn More about Your Legal Options!

Most people believe that once your workers' compensation claim is settled no further options are available. However, if your injury or illness worsens and you require additional medical treatment outside of what your settlement provides, you do have options. Fortunately, there may be certain routes you can take, including re-opening an initial claim.

At Smolich & Smolich, our Sacramento workers' compensation lawyers can sit down with you during a free case evaluation, better understand your changing circumstances, and help you figure out your options.

At Smolich & Smolich, we are:

  • Certified Specialists in Workers' Compensation by the California State Bar
  • Dedicated to helping you understand all options available
  • Ready to represent you as we seek additional compensation after an initial settlement

Re-Opening a Claim Settled by a Stipulated Finding & Award

There are two ways to settle a worker's compensation case which include a Stipulated Finding and an Award and Compromise by Release. If you settled through a Compromise and Release, the terms state that you have terminated your right to future medical care and the insurance company will not pay for any additional treatment needs that arise.

However, if you settled your case through a Stipulated Finding and Award and your injury or illness gets worse you may be able to re-open the claim. In order to do this, you must have suffered a new injury or illness that causes your initial one to worsen.

Get the Additional Medical Care You Need

If you require further medical care than you initially thought, turn to our experienced workers' compensation lawyers at Smolich & Smolich for assistance. We can evaluate your situation and, if possible, help you re-open your claim as you seek additional compensation for treatment.

  • Without Smolich & Smolich taking my case I would have never gotten my benefits!!!

“Without Smolich & Smolich taking my case I would have never gotten my benefits!!! Rob Smolich took my case himself and was so helpful in every step of the way. I cant say anything negative about Smolich & Smolich. I had a lawyer before him and he was way more personable. His office took all the stress off my back and made me feel at ease during the time period of waiting. Have nothing but good things to say about this company. They are completely professional!!!!”

  • They know what it takes to win. Thank you all so much!

“Thank you so much for your help. I was denied twice by social security disability. They are the most diligent and wonderfully. Yes it takes a while to get a hearing. If it wasn't for the great staff and attorneys here, I would have never been approved for disability. It was the best Christmas gift i received. They know what it takes to win. Thank you all so much!”
